These Terms of Service ("Terms") govern your use of the Resonape application and website (the "Service") operated by Boushell ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Accounts

To access certain features of the Service, you must create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access.

3. User-Generated Content

The Service allows you to post comments, replies, and votes on shared links ("User Content"). You retain ownership of your User Content, but by posting it you grant us a worldwide, non-exclusive, royalty-free license to display, distribute, and make your User Content available to other users as part of the Service.

You agree not to post User Content that:

  • Is unlawful, threatening, abusive, harassing, defamatory, or obscene
  • Infringes on the intellectual property rights of others
  • Contains spam, advertising, or unsolicited promotions
  • Impersonates another person or entity
  • Contains malware, viruses, or other harmful code
  • Violates the privacy of others

We reserve the right to remove any User Content that violates these Terms or that we find objectionable, without prior notice.

4. Shared Links

The Service allows you to share URLs from third-party websites. We automatically retrieve publicly available metadata (title, description, image) from those URLs for display purposes. We are not responsible for the content of any third-party websites linked through the Service.

5. Voting and Sentiment

The Service allows users to upvote and downvote comments. Comment scores and sentiment analysis results are generated automatically and reflect community activity. We do not guarantee the accuracy of sentiment scores and they should not be taken as authoritative measures of public opinion.

6. Subscriptions and Payments

Certain features of the Service may require a paid subscription. Payment processing is handled by Stripe. By subscribing, you agree to pay the applicable fees and authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of your current billing period.

7. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated means (bots, scrapers) to access the Service without permission
  • Circumvent any rate limiting or security measures
  • Create multiple accounts to manipulate votes or sentiment scores

8. Intellectual Property

The Service, including its design, features, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

9. Termination

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time, which will permanently remove your personal data and User Content from our systems.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We are not responsible for User Content posted by other users.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, revenue, or profits.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
